Dell Technologies Partners’ Compliance Obligations

Dell Technologies is committed to responsible business practices and to high standards of ethical behavior. This includes holding our Partners to recognized international standards and conventions and global best practices. In this sense, in addition to other contractual and/or programmatical obligations, Partners MUST: .

Comply with the obligations under the Dell Technologies Partner Code of Conduct.

Maintain true, accurate, and complete accounting records: concerning the sale, use and licensing of the Dell Technologies Products and Services. It is important to never establish or use “side funds”, “off-book funds”, “slush funds”, or any undisclosed or unrecorded company funds, such as spreadsheets itemizing reserves of cash, for illegal activities, personal use, or any other purpose. 

Adhere to both U.S. and global trade laws : regardless of the country in which you do business in, including: .obtain and comply with the requirements of all export and re-export licenses; .screen end users against restricted US party lists; .comply with anti-boycott laws effective in jurisdictions where Dell does business; .ensure business is not carried out by individuals, entities, countries or territories sanctioned by the US (including, North Korea, Cuba, Iran, Sudan, Syria, Crimea, Russia, Belarus, Donetsk & Luhansk regions in Ukraine);

ensure that these obligations are followed by end users and third parties that cooperate with them : .

Abide by all relevant Anti-Corruption Laws: including the U.S. Foreign Corrupt Practices Act and the UK Bribery Act, regardless of the country in which you do business, and: maintain, monitor and enforce anti-corruption policies, procedures and internal controls & provide copies of such documents upon request; conduct risk-based due diligence on third parties engaged in Dell Technologies business; provide reasonable gifts and hospitality appropriately and in compliance with Anti-Corruption Laws and MDF terms and conditions, as required; complete all assigned training; and never offer a bribe, either directly or through a third party, to win business.

Ensure compliance with global Competition laws which generally : prohibit (1) price fixing; (ii) market and customer allocation; (iii) limiting production or supply of products/services; (iv) group boycott, or (v) bids rigging. Make sure to check the laws in countries where you do business or effects of your business are felt to ensure compliance with regional rules.

TERMS AND CONDITIONS OF SALE

TITLE: The title of goods remains the property of Etech ICT until payment is made in full.

CREDITS: No credit will be raised until goods are returned to Etech together with a return authority form.

RETURNS: No goods may be returned without prior authorization number and original packaging. Where goods have been ordered incorrectly in such cases a 20% Restocking Fees will apply. If returned in a damaged or defaced condition then goods do not qualify for a refund. However if damage is due to manufacturing process then full refund will apply or goods will be replaced promptly with no further charge.

PRICES AND AVAILABILITY: These are subject to variation due to exchange rate flactuation and stock constrain without prior notification.

GST: The item price and freight cost are subject to 10% Goods and Services Tax.

TERMS: The Terms are strictly 14 or 30 days from date of invoice for customers with credit account subject to approval. We reserve the right to charge interest, not exceeding the bank overdraft rate payable by Digitec on accounts whose balance is not within our trading terms.

IMAGES DISPLAYED: These are accurate to the best of our knowledge and for illustration purpose only. Etech will not be held responsible for purchases based solely on these Images.

WARRANTY: Etech warrant that the products sold are fit for the purpose for which they are manufactured. This warranty will not apply unless the goods are used properly and in accordance with the manufacturer instructions for use or storage, notwithstanding anything else herein, contained or implied, Etech will not be liable for any resultant, incidental or consequential loss arising out of any fault or defect in the goods sold herein and any liability of Etech shall be confined to the amount of the relevant invoice or items.

Product replacement under warranty is only possible within Seven (7) days of Invoice Date, and is subject to no physical damage and packed in original packaging.

A Copy of the Invoice must be produced while claiming any Warranty. All Warranty Claim will be rejected if no Invoice is produced on demand. Average time for the defective product to be repaired or replaced under warranty is 2 to 6 Weeks.

GENERAL WARRANTY TERMS AND CONDITION:

The Following issues are not deemed to be Warranty Fault and the Customer will be liable for a Fee should a request is made to remedy a fault caused by one of the issues below. Etech will provide a quotation prior to proceeding with repairs. A Mandatory service fees of K88.00 will apply should the customer do not proceed with the repair

  1. Operating System malfunction, Software Installation, Activation, and Updates.

  2. Any damage caused to the operating system or application due to virus attack and Removal.

  3. The Customer is responsible of taking Data Backup prior to handing over equipment for repair.

  4. Warranty is void in case of physical damage, liquid spillage, and sign of rusting, mishandling, damage due to power fluctuation and tempering of serial number, Service Tag or Warranty Seal.

  5. General wear and tear due to age.

TRADEMARKS AND LOGO: All Trademarks and Logos used on this web site remain the property of their registered respective owners.

CONFIDENTIALITY: All materials supplied by Etech remain the property of Etech ICT and remain confidential. Materials supplied, i.e. cross reference guides, manuals, specifications etc, are confidential and may not be made available to a third party without the written approval of Etech. Such confidential material must be returned on request.
